Apple Isle Car Hire Rental Terms for travel between 01-Jan-2009 and 31-Dec-2014

Terms and Conditions
Please note - within these terms and conditions the term "You" refers to the main hirer and any authorised drivers and "Us" "Our" and "We" refers to Apple Isle Car Hire and its employees.

Drivers license: You agree and acknowledge that:
(a) only You or an Authorised Driver will drive the Vehicle; and
(b) You and any Authorised Driver are currently licensed to drive the Vehicle and have been so licensed to drive for a period of 12 months or longer (excluding any time under a learner's permit or a provisional license).

Restrictions If you have a valid International Drivers License or a License which is in English then you are able to drive in Australia. You are unable to drive in Australia if your Driver's license is in another language other than English.

Payment
An initial, non refundable deposit will be secured at the time of booking confirmation. Accepted credit cards are Visa and Mastercard (transaction fee of 1.75% applies).

The balance due will be secured prior to your arrival to pick up your vehicle. Please arrange to have the funds available on your nominated account a few days prior to pick up. Accepted credit cards include Visa and Mastercard.

Bond Deposit
A deposit of $500 is required for all vehicles at time of pick up. On return of the vehicle, provided no accident or damage has occurred, the vehicle is completely clean and fuel tanks full then the deposit will be returned. Payments made via credit card (Mastercard and Visa Only).

Refunds
There are no refunds for vehicles returned earlier than the agreed time.

Credit Cards
For security purposes of the credit card holder You must have a credit card in Your own name. A credit card authorisation is required to pickup this rental. Any fees payable within these terms and conditions will be charged to the credit card presented at time of hire.

Age
Drivers must be aged over 21 and meet all above criteria.

Tow Bars
Tow bars (or trailer hitches) may not be used with any vehicle excepting with prior arrangement with Apple Isle Car Hire confirmed in writing.

Late charges
Many rates, like weekend specials, are only available during certain time periods. Returning the car after or even before the designated time might affect the rate quoted. Returning the car by the agreed-upon time also helps ensure that all other customers will have their reserved car available upon their arrival.

Change of vehicle
Although every effort is made to ensure the vehicle booked is available, we reserve the right to substitute a comparable or superior vehicle at no extra cost in extreme circumstances. This shall not constitute a breach of contract and does not entitle the renter to any refund whatsoever.

Where you can/cannot drive the vehicle  
You and any Authorised Driver must only use the Vehicle on a road, which is properly formed and constructed as a sealed or gravel road.

No Apple Isle Car Hire vehicle is to be driven off road (examples include but not limited to; dirt tracks, paddocks, fields or trails) and no Apple Isle Car Hire Vehicle is to be driven through floods, creeks or rivers or where water damage is likely to occur. Convertibles must not be left with the top down.

All rentals are based on unlimited kilometres.

The Vehicle may not be driven into or out of Tasmania or driven above the snow line

You and any Authorised Driver must:

(a) not allow the Vehicle to be used for any illegal purpose, race, contest or performance test of any kind;

(b) not allow the Vehicle to be used to tow or push anything;

(c) not carry more passengers than may be properly accommodated by the seat belt restraints provided in the Vehicle, or carry a greater load than that for which it was built;

(d) not be under the influence of alcohol, drugs or have a blood alcohol content that exceeds the legal limit in the State or Territory in which the Vehicle is driven;

(e) not allow the Vehicle to be used to carry passengers for payment of any kind;

(f) not use the Vehicle when it is damaged or unsafe;

(g) not use the Vehicle to transport goods, except in compliance with all necessary approvals, permits, licenses and government requirements (to be obtained at Your cost) and in accordance with the Vehicle manufacturer's and Apple Isle Car Hire' recommendations;

(h) not, without Apple Isle Car Hire's prior written consent, use the Vehicle to carry any flammable substance which has a flash point under 22.8°C or any other explosive or corrosive substances;

(i) not use the vehicle to transport pets or any animal; and

(j) not use the Vehicle in contravention of any law.

(k) Submit to any test to determine the level of alcohol or drugs in the blood when reasonably requested by the police.

ALL INSURANCE AND REFUNDABLE MONEY IS WAIVED IF THE ABOVE RESTRICTIONS ARE BREACHED. ANY DAMAGE AND/OR RECOVERY COSTS ARE THE CUSTOMERS RESPONSIBILTY.

LOSS DAMAGE WAIVER, DAMAGE AND LOSS OF PROPERTY
You are liable:

(a) for the loss of, and all damage to, the Vehicle;

(b) which is caused or contributed to by You or an Authorised Driver; or

(c) which arises from the use of the Vehicle ( or its parts or its contents) by You or an Authorised Driver.
You are responsible for any damage to the vehicle until it is back in the possession of or collected by an Apple Isle Car Hire staff member.

Insurance
Insurance: Vehicles are comprehensively covered as per below details:
Class A vehicles: In the event of a claim You are liable to pay an excess:
$500 up to a maximum of $2000 for hirers aged 25 years plus
$750 up to a maximum of $2500 for hirers aged 21 to 25 years.
Class B vehicles: In the event of a claim You are liable to pay an excess of up to $5000.
For all categories of vehicles the cost of windscreen loss not covered by insurance and is payable to a maximum of $180, any difference in price will be met by Apple isle Car Hire. Stone chips to windscreens are payable at cost of repair.
Theft or damage resulting from failure to lock the vehicle or failure to keep the keys secure is not covered by insurance and You are liable for any loss or damage in this instance. Loss of keys and associated costs will be charged to the main hirer.
Tyre damage cover is complimentary assuming all conditions of the hire agreement are complied with.
In the event of an accident or damage caused to the vehicle insurance cover may be waived if you do not do the following:
You must report to Us, the police and any relevant authority any incident involving loss or damage to the Vehicle or any other property or injury to any person within 24 hours of the incident occurring.
You must provide such information and assistance as may be requested by Us including, but not limited to, being interviewed by an investigator, or attending any Court hearing, and if necessary, authorising Us to bring, defend or settle legal proceedings. However, We shall have sole conduct of any such proceedings; You must give to Us promptly every summons, complaint, demand or notice in relation to any loss or damage;
You must not leave the scene of an accident without providing full particulars to all relevant persons and authorities;
You must not provide any false information, nor engage in any fraudulent activity, in respect of Your hire of the Vehicle or in Your dealings with any law enforcement officer or authority during the period;
You must not, without Our consent, make or give any offer, promise of payment, settlement, waiver, release, indemnity or admission of liability.

Drop off destination
Change of drop off destination must be authorised by Apple Isle Car Hire- if authorisation is given a fee of up to $500 may apply. Apple Isle Car Hire does not offer pickup or return to locations outside the Greater Launceston Area.

Cleaning Fee
A fee of up to $100 may apply if the vehicle is not returned in the same condition as when it was issued freshly washed and vacuumed. Charging of such a fee is at discretion of the manager of Apple Isle Car Hire.

Smoking is not permitted in any Apple Isle Car Hire vehicle

Breakdowns
Apple Isle Car Hire vehicles are covered for breakdowns by RACT 13 1111. In the unlikely event of a breakdown please contact Us on 04 3148 7050 initially. If You contact RACT without first contacting Us You may be liable for any costs incurred as a result. You the hirer are responsible for any costs incurred as a result of failure to refuel - if RACT needs to attend due to lack of fuel You must pay associated fees.

Repairs
You must pay for any unauthorised repairs to the Vehicle and for all parking and traffic infringements in respect of the Vehicle during the Rental Period. We will not accept responsibility for hotel or motel charges, meals or out of pocket expenses - in the case of breakdown, liability will be limited to the refund of hire charges for any days lost.

Contents of Vehicle

When issued for hire all cars will have cigarette lighters and tyre changing equipment in place-hirer is to ensure these remain with the vehicle when it is returned or a fee for replacement at manufacturer's retail price will be charged.

Please note: Apple Isle Car Hire reserve the right to refuse any rental at it's discretion.

Cancellation
The initial deposit secured on booking confirmation is non-refundable, in addition to this the following costs will apply:
$50.00 from your nominated credit card account to supplier will be required in the case of cancellation or 'no show'.

In such a case, if you book with us at a quoted rate that is incorrect, we will notify you of any price change and give you the option to proceed or cancel. We make every effort to keep information on our site up to date, but we cannot guarantee this website is free of errors or omissions and retain the right to update or change the information published at any time.

Liability
To the extent permitted by law we/the owners of this website will not be liable to you or to any third party (whether in contract, tort, or otherwise) for any direct, indirect or consequential loss or damage (including but not limited to any accident, injury, delay or loss of enjoyment) arising out of your reliance upon information contained on this website, including but not limited to your use (or inability to use) any products or services described or procured through this website.

When you pick up your vehicle, you will be required to sign a rental agreement with the supplier of the vehicle. Your rental and use of the vehicle will be governed by the terms of the rental agreement and any other documentation or information provided to you by the supplier at the time you pick up your vehicle. The rental agreement is between you and the supplier and we will not be liable to you or to any third party in relation to the terms of the supplier’s rental agreement or any other documentation provided to you by the supplier at the time of pick up.

While we will make reasonable efforts to ensure we are representing only reputable suppliers, we make no warranty about the fitness or suitability of any third party (supplier) product or service and will not accept responsibility for the quality or fitness of any vehicle. We welcome feedback from our customers on their experience with our suppliers. We may, at our discretion, provide you with reasonable assistance in resolving any dispute you may have with a supplier.

Our total liability to you in relation to your use of this website and the information contained on this website will not exceed the dollar amount of the deposit we have received from you in relation to your booking/rental. Refunds will not be made for bookings cancelled due to inclement weather. Again, we strongly recommend that you take out travel insurance. Your use of this website is governed by the laws of New Zealand and the jurisdiction of the New Zealand courts.

Booking information
To make a booking you must complete our booking form which is easy to follow and secured with the latest encryption technology. Once we receive your form, we will, subject to availability, confirm your booking by emailing you a confirmation voucher and invoice. The deposit required to secure your vehicle (as shown on the secure booking page) will only be processed on your credit card when your booking is confirmed. Please note that a 1.75% credit card charge will be added when your payment is processed.

A booking is confirmed when you have been emailed a confirmation voucher and at this stage the deposit is processed on your card and becomes non-refundable and any cancellation fees stated in the supplier's terms apply. Upon receipt of your confirmation, please check your details carefully and notify us immediately if there are any incorrect details, as it may not be possible to make changes at a later date.

If you are booking via phone, please make sure you have read the terms and conditions of the vehicle you wish to rent first. Our reservations consultant will ask you if you have read the terms and agree to them before proceeding. The onus is always on the renter to ensure they make themselves fully aware of the terms displayed on our website.

Information disclosure
In booking on this website you acknowledge that we disclose your information to your selected Supplier in order to provide the requested rental services.

Amendments
Please note that some suppliers treat an amendment as a new booking and apply the rate current at the time the amendment is made to recalculate the entire booking amount (not just the days changed). If the rental period is increased, an additional deposit may be required. If the rental period is shortened which results in a reduction of the rental charges, the deposit amount will remain unchanged, and the difference between the original and revised deposit is forfeited (it cannot be used towards remaining rental charges). To request a change to a confirmed booking, please use the alterations request link on your confirmation. Any alterations are subject to availability and the approval of the supplier. In addition to the alteration policy of the supplier stated in their terms, the following charges will apply:
Car rental alterations (all charges stated in local currency):
To change dates or times that result in a recalculation of rental rates, or to change vehicles or locations: 25.00
To add or remove extras to/from a confirmed booking: 10.00
Motorhome rental alterations (all charges stated in local currency):
To change dates or times that result in a recalculation of rental rates, or to change vehicles or locations: 75.00
To add or remove extras to/from confirmed booking: 20.00
The alteration fee will not be charged if your alteration request is not possible.

Vehicle Capacity and fitness to drive
Under no circumstances are you permitted to carry more passengers than the vehicle you rent is legally registered to carry, and if you do your insurance may be invalidated. The number of seatbelts (and passengers) is indicated next to each vehicle on this website. Luggage capacity where shown is an indication only and we will not be responsible should you be unable to fit your entire luggage into a vehicle. It is your responsibility to choose a journey that is within your capabilities. A vehicle supplier can refuse to rent a vehicle to any person who is in their opinion unfit to drive or does not meet eligibility requirements. In such circumstances we will have no further liability to you.

This is near Aurora Stadium- straight down Tamar St, across the bridge and turn left at Gleadow St. If you can see the Mazda Dealership you are right near us!

Airport Pick up
Go to the baggage claim end of the Launceston airport in the pickup/drop off area and look out for a car with an Apple Isle sign on it. This is a free service.

Airport Drop Off
You are welcome to drop off your vehicle at the airport after your journey - there is a fee for this service. This is $5.00 AU
